#Retroactivity
I really do think the retroactivity of Labour's immigration reforms is one of the most genuinely shocking breaches of basic governing principles in my lifetime. At the risk of deploying the slippery slope fallacy, once we allow retroactivity in one area of law, where do we allow it next?

So Mahmood is planning on an element of retroactivity for settlement routes. There is nothing fair about changing the rules after people have already arrived and started their visa routes.

The Labour lack of retroactivity was an unpopular choice with the UK public but they still went ahead. Unbelievable.
Times: ‘The Boriswave is now the Burnhamwave, and it may overwhelm Labour at the next election"

Difficult to find a basis for this electoral hunch.

YouGov: Most Labour voters would not have made changes to settlement to those already in the UK at all. (Most Reform voters would. Cons voters split)

We have had retroactivity in English law since at least the 11th century.

Article 7 ECHR against retroactivity of criminal offences is the closest one's going to get. Ultimately, parliamentary supremacy is going to trump any prohibition.

Older hybrid cars have their road tax based on co2 and get a massive discount. My newer hybrid pays the standard annual rate despite being more efficient. Pre 1997 licenses are grandfathered to drive more categories of vehicles.

Retroactivity unthinkable except when its about race.

Let's just clear up one or two things about this Zuckerberg story. www.nytimes.com/2026/10/22/b...

1. Moving in September would not have reduced the billionaire tax at all. At best, it would have given him standing to bring a long-shot retroactivity argument that will get rational-basis review.

The agreement that Mark Zuckerberg, Meta’s chief executive, cut to stay in California underscores businesses’ fears about a major tax proposal.

Models committee backs package to update withdrawal-assessment tool but council seeks testing and validation
The models committee recommended replacing the tool's '0.5 max' depletion allocation with WebSquared/adjacent-expanding methods and updating transmissivity and storage coefficients derived from kriging analyses. Council members repeatedly requested pilot testing, external validation (pump-test and agricultural data) and a non-retroactivity assurance before statewide adoption.

Thimmesch on Adjudicative Retroactivity and Constitutional Safe Harbors
Adam B. Thimmesch (University of Nebraska at Lincoln – College of Law) has posted Adjudicative Retroactivity and Constitutional Safe Harbors on SSRN. Here is the abstract: The Supreme Court’s retroactivity doctrine, together with much of the accompanying legal scholarship, has increasingly treated federal adjudication as necessarily retroactive. But that understanding emerged largely in the context of a constitutional history marked by the expansion of individual rights and by corresponding limits on government power.
