Eligible Californians might wanna get on the horn to an attorney.

The Governor just signed my bill to allow people to sue ICE, Border Patrol, and other federal agents for violating people’s constitutional rights. Starting immediately, people can sue federal agents retroactive to abuse occurring in March 2025.

Now: Gov. Gavin Newsom signed Sen. Scott Wiener’s SB747 Tuesday as part of a slate of bills designed to combat the Trump administration’s immigration crackdown.

Everyone should be aware of SB747 in California. The "No Kings" act has been cooking around since mid-2025 but recently passed state senate. it allows citizens to sue ICE agents who violate the law. Once it passes Assembly, it will be a model for accountability

For CALIFORNIA:

You can call your state senator and tell them to support Weiner's SB-747 as amended: legiscan.com/CA/text/SB74...

(There is some weird political game playing nonsense where old versions of this bill had some behavioral health stuff lumped in, careful what version you read.)

California‘s legislators are finally turning to what may be the most powerful tool to constrain Trump’s lawlessness. My op-ed on @scottwiener.bsky.social’s SB747 in the @sfchronicle.com www.sfchronicle.com/opinion/open...
California can use these three words in the Constitution to push back against Trump
OPINION: The California legislature has a powerful potential tool to push back against the excesses of the Trump administration. They just need to pass this law.

George Retes, a U.S. veteran, was held by ICE for 3 days — no charges, no explanation. State officers can be sued for this. Federal agents can't. SB747 closes that gap. #NoKingsAct

This first-in-the-nation right of action closes long-standing loopholes to ensure that NO ONE, not even the federal government, gets to stand above the Constitution.

Constitutional rights mean nothing without accountability. The No Kings Act (SB 747) lets Californians seek justice when federal officials violate those rights. Real safety requires accountability at every level of government. #NoKingsAct #SB747 #CAleg

Ok I know this is old news for some, but FYI: you can use legiscan.com for free to track bills winding their way through your state legislature. I found this useful last year in tracking SB79 and knowing when I needed to make calls.

Federal immigration crackdowns are eroding trust and making communities less safe. That’s why Prosecutors Alliance Action is backing California’s #NoSecretPolice (SB747) and #NoKingsAct — to ensure transparency and real accountability.

No masks. No one above the law.

Support SB747
**Support SB 747 to Protect Constitutional Rights in California** I am writing to urge your support for SB 747, which is currently ordered to third reading as of January 26, 2026. This bill creates essential protections for Californians whose federal constitutional rights are violated by those acting under color of law. SB 747 establishes a state-level cause of action mirroring federal civil rights law under 42 U.S.C. § 1983. This is critically important because it ensures California residents have a reliable avenue to seek redress when government actors deprive them of rights secured by the United States Constitution. While federal law theoretically provides this protection, creating a parallel state remedy strengthens accountability and ensures access to justice remains available regardless of changes in federal enforcement priorities or court interpretations. The bill builds thoughtfully on California's existing Tom Bane Civil Rights Act framework. It includes reasonable safeguards such as a two-year statute of limitations and allows defendants to assert absolute or qualified immunity defenses to the same extent as in federal actions. The bill explicitly preserves sovereign immunity defenses, demonstrating a balanced approach that protects individual rights without exposing government entities to frivolous litigation. By authorizing courts to award attorney's fees and expert costs to prevailing plaintiffs, SB 747 makes it financially feasible for individuals to pursue legitimate civil rights claims. Without this provision, many people whose rights are violated would lack the resources to hold government actors accountable. This is particularly important for marginalized communities who face disproportionate civil rights violations but often cannot afford lengthy legal battles. The bill's retroactive application to March 1, 2025 ensures that recent violations are not left without remedy during this transition period. Given the bill's advancement through both the Senate Judiciary and Labor committees, it has received thorough vetting on its legal and practical implications. I respectfully ask that you vote yes on SB 747 to strengthen civil rights protections for all Californians.
