Got a letter from the Office of Civil Rights at HHS re: the complaints lodged against Jamie Reed, the alleged trans clinic "whistleblower" who disclosed patient health information in violation of privacy regulations.
Dear Christine Schorb: The U.S. Department of Health and Human Services (“HHS”), Office for Civil Rights (“OCR”), conducted an investigation of Washington University Transgender Center (“the Center”), which is part of Washington University School of Medicine (“WUSM”), after receiving multiple complaints alleging the Center may have violated the Federal Standards for Privacy of Individually Identifiable Health Information and the Security Standards for the Protection of Electronic Protected Health Information (45 C.F.R. Parts 160 and 164, Subparts A, C, and E, the Privacy and Security Rules), and the Breach Notification Rule Subpart D - Notification in Case of Breach of Unsecured Protected Health Information (45 C.F.R. §§ 164.400- 164.414). Specifically, OCR investigated whether Jamie Reed, a former case manager at the Center, impermissibly accessed, used, and disclosed protected health information (“PHI”), including whether Ms. Reed impermissibly disclosed PHI in her article in The Free Press that highlighted a patient custody case and contained medical information about a child.1 OCR enforces federal civil rights laws which prohibit discrimination in the delivery of health and human services based on race, color, national origin, disability, age, sex, religion, and the exercise of conscience, and also enforces the Health Insurance Portability and Accountability Act (HIPAA) Privacy, Security and Breach Notification Rules. OCR notified the WUSM of these complaints. WUSM provided a written response to the allegations, requested policies and procedures, and evidence that it provided breach notification as required by 45 C.F.R. §§ 164.404, 164.408(c). Pursuant to its authority under 45 C.F.R. §§ 160.304(a) and (b), OCR has determined to resolve this matter informally through the provision of technical assistance to WUSM. Specifically, the HIPAA Security Rule requires covered entities to implement procedures to regularly review records of information system activity, such as audit logs, access reports, and security incident tracking reports.2 The Security Rule also requires that a covered entity implement policies and procedures to ensure that all members of its workforce have appropriate access to ePHI and to prevent workforce members who do not have authorized access from obtaining access.3 Additionally, a covered entity is required to apply appropriate sanctions against workforce members who fail to comply with the security policies and procedures of the covered entity.4 OCR’s website also provides relevant guidance: Security Rule Guidance Material | HHS.gov October 2023 OCR Cybersecurity Newsletter | HHS.gov Summer 2021 OCR Cybersecurity Newsletter | HHS.gov Summer 2019 OCR Cybersecurity Newsletter | HHS.gov WUSM is encouraged to review the above cited regulations and guidance closely and to share them with its staff as part of the HIPAA training it provide to its workforce. WUSM is also encouraged to assess and determine whether there may have been any noncompliance as alleged by the complainants in this matter, and, if so, to take the steps necessary to ensure such noncompliance does not occur in the future. Should OCR receive a similar allegation of noncompliance against WUSM in the future, OCR may initiate a formal investigation of that matter. In addition, please note that, after a period of six months has passed, OCR may initiate and conduct a compliance review of WUSM related to its compliance with the HIPAA Rules. Based on the foregoing, OCR is closing this matter without further action, effective the date of this letter. OCR’s determination as stated in this letter applies only to the allegations in the complaints that were reviewed by OCR and the transactions cited in the reference line of this letter.
