It would also not override these state laws prohibiting exclusions against trans care, so insurers in those states would still need to abide by these laws. The ACA also federally prohibits sex discrimination in health programs which federal courts have often ruled includes these exclusions
EHBs function as a "minimum" or "floor" for insurers on ACA plans, and states can add their own EHBs to the government's list of 10. I'm only aware of one state (CO) that lists trans care as an EHB--but 24 states + DC explicitly prohibit exclusions against trans care *by law*
