A little-discussed element of the Mississippi Vagrancy Law, the most famous of the postemancipation Black Codes, criminalized "usually associating... on terms of equality" with Black Mississippians. The law literally prohibited treating Black residents as equals.

By refusing to provide evidence for his historical claims or data/details to understand his moral argument, Wurman traffics in the same vague bigotry used against every immigrant group to ever reach America’s shores. And it is the same rhetorical move made against Black freedmen in Reconstruction.

There's also the delight in perversely misreading history that really isn't contested or poorly understood.

e.g. Thomas's insistence that in the 1860s, "freedmen" was "a formerly race-neutral category"
I think it’s hard to understate the extent to which two-century old history is incomplete, contradictory, and subject to multiple interpretations—and thus fundamentally incapable of providing the sort of clear guidance Originalists claim that it can.
The court's new hyper-literal originalism is producing a weird jurisprudence in which some cases turn on two competing, highly subjective, highly-distilled, multi-century historical narratives. The narrative that gets 5 votes then becomes "Official U.S. History" for every similar case that follows.

for those unfamiliar: there already was a faction of politicians known by the moniker "radical Republicans" and they were known mostly for their uncompromising opposition to slavery, support for pro labor legislation, and passage of 1860s Civil Rights legislation that empowered freedmen
