Virginia Gov @abigailspanberger.com and Democratic legislature should pass immediate legislation to redistrict anyway. If the old confederate states can do it post Callais - so can Dems in Virginia if they care about saving our democracy.

Suuuuper interesting, I was not tracking this. The judge found the law criminalizing noncitizen voting is a voter qualification statute, and therefore outside of Congress’s power.

Surprisingly, this is an issue of first impression!

A statute may "enshrine a tradition," but that is not the only thing it does. A statute codifies law, just the same as statutes criminalizing homicide and bank robbery, and it is just as "clear" that violating the statute is unlawful.
It is not clear that Mr. Trump’s image can be featured on a coin. An 1866 law enshrined a tradition that only deceased people could appear on U.S. currency to avoid the appearance that America was a monarchy. Trump admin is planning to do it anyway.

These same Justices held Biden could not use a statute passed by Congress for student debt relief because the statute authorized it but needed to extra double authorize it.

But for Trump, he can simply ignore statutes and appropriations entirely, Congress is irrelevant.

CA: Second half of statute is very clear delegation of discretion to president. Contrast with first part, with conditions.

Judge (agreeing): Beginning of statute could have said "Whenever president finds" rather than "Whenever X happens"! But statute not written that way.

My three kids became U.S. citizens upon adoption under a statute. Nevertheless we are getting them passport cards to carry, and I think there is a distinct possibility that statute may be attacked, and retroactively, by the scum running the country.
