A failed lethal injection in Tennessee is renewing calls in Pennsylvania to permanently ban the death penalty, as lawmakers consider whether the state should move from a long-standing moratorium to full repeal. Pennsylvania has not carried out an execution since Gary Heidnick’s in 1999. In 2015, former Gov. Tom Wolf announced a moratorium on executions, citing how much the process cost the state. Gov. Josh Shapiro continued that moratorium in 2023. Democratic state Rep. Chris Rabb of Philadelphia County said the Tennessee case underscores the need for Pennsylvania’s Legislature to take up the issue. “In light of what happened in Tennessee, it seems appropriate for our body to bring this up for a vote,” Rabb said. In Tennessee, Christa Pike survived two doses of lethal injection in a prison Wednesday and remains in critical condition in a Nashville hospital receiving life-saving care. Rabb, who has worked to repeal the death penalty in Pennsylvania for 10 years, criticized the execution process and questioned its impact on victims’ families. “They can't even kill a person, I want say appropriately, but that hurts my heart to say. It does nothing for the families of the victims. It certainly is cruel to the person being killed, as though being killed is not cruel in and of itself. But they can't even get that right,” Rabb said. Rabb said he opposes capital punishment on moral and financial grounds. “I don't believe that our government has the moral authority to kill anyone. We've also spent over a billion dollars over 35 years, just to have a death row,” he said. He said people are on death row for an average of 17 years, arguing that delays mean there is no satisfaction for victims’ families and that there is no “one hundred percent certainty” that every person on death row is guilty. “This is a matter of - are we in the business of revenge? Or are we in the business of making sure that our communities are safe and that for those who are able and willing to be rehabilitated can do so?” Rabb said. Rabb’s bill to repeal the death penalty has bipartisan support and was voted out of the House Judiciary Committee in April, but it is still awaiting a floor vote. “Let's get it over the finish line in the remaining days of this legislative session,” Rabb said. There are currently 94 people on death row in Pennsylvania. If the state bans the practice, it would join 23 other states that have outlawed it.
