NHS staff in England suspected of looking at patient records without a valid reason will be immediately suspended as part of a "zero-tolerance crackdown" on snooping. Those under suspicion will also be locked out of NHS computer systems, preventing any further viewing of confidential records, including from home. NHS England chief executive Sir Jim Mackey has written to every trust, ordering the measures to be introduced immediately to strengthen protection against data breaches.

A senior NHS official privately urged colleagues to add more patient data into a Palantir-built platform at the same time as he was being paid to advise the US technology company. Matthew Swindells has been joint chair of four major hospital trusts in north-west London since April 2022 and has also since then acted as an adviser to Palantir through the now-defunct lobbying firm Global Counsel, which was co-founded by Lord Peter Mandelson.

Huh.
The DPIA we reviewed stated that access to identifiable patient information would be limited to NHS staff with a legitimate need. However, since then, recent media reporting, and subsequent confirmation from the programme team, indicate that some external contractor staff also have access to identifiable patient information within the National Data Integration Tenant (NDIT) environment. We were not aware of this. We have therefore written to the programme to seek clarification on this inconsistency.

We shouldn't only focus on the positive aspects of data use. It's important to also discuss potential risks, safeguards, and plans for when things go wrong. Because despite everyone's best efforts, mistakes and deliberate wrongdoing can occur. People have valid concerns about cyber-crime, data breaches, and disruption to critical services. Organisations must demonstrate they not only have strong data privacy protections in place but also well-thought-out and tested business continuity plans. These plans are crucial to ensure they can continue to deliver safe care even if their digital systems are unavailable.

The second dimension to the general discourse on FDP – the choice of supplier(s) to provision the FDP – is not a matter over which CDAOs have a say [although we believe as a general point that it is a missed opportunity to not have been more involved in the procurement as potential future users]. It is for NHSE to address any public concerns about procurement or its choice of supplier(s). However, public trust around the use of sensitive data is hard won and easily lost. This relationship of trust with our citizens requires constant and careful attention and we receive regular expressions of interest and concern about health data use including specifically the extent of our engagement with FDP and its supplier(s). We must take into consideration in the development of our local data assets and demonstrate responsiveness to these concerns if we are to safeguard and preserve this trust.

The Bill (clause 77) disapplies the existing requirement to provide information to data subjects when personal data is processed for a further, separate, purpose if it is for scientific research and would require 'disproportionate effort' to provide this information. We are deeply concerned that this provision will water down the transparency of information to patients. Any reduction in transparency requirements is a backward step in terms of promoting confidence in the use of health data, given the very close relationship between transparency and public trust. It contradicts the approach in the recently published ICO guidance about improving transparency in health and social care. Disapplying transparency requirements is contrary to societal expectations – more, not less, transparency is required to build and maintain public trust – and reducing transparency is also in direct contradiction to the National Data Guardian's (NDG) advice that there should be 'no surprises' for patients about how and why their data is used.

The issue emerged because journals and funders increasingly require researchers to publish the code they have used to analyse large datasets. When intending to upload code, some researchers have also accidentally published partial or entire Biobank datasets to GitHub, a popular online code-sharing platform. UK Biobank prohibits researchers from sharing data outside their systems and says it has introduced further training for all researchers. In the past year, the data leaks appear to have become a more urgent concern to UK Biobank. Between July and December 2025, it issued 80 legal notices to GitHub, which has complied with requests to remove data from the internet. Yet much still remains available.

A leaked draft report from the digital and technology working group, ahead of the plan which is expected to be published in spring 2025, outlines a vision for the NHS centred on digitally enhanced and inclusive care. To achieve this, it calls for "a wholesale upgrade of technology foundations, progressive replacement of legacy systems, and transformational use of automation and AI to improve productivity and empower patients". The paper recommends the adoption of a "universal record used across all settings such that relevant personal information is accessible to involved workers with agreed levels of access". Patients, researchers and policymakers would also be able to access the record, with anonymised healthcare information "made available for research purposes by default, with opt out available by exception".

Following the initial discussion with the National Data Guardian, NHS England decided not to pursue the topic of adding a patient-facing function to GP Connect. It would have had a limited application and been technically and legally complex to implement, as noted in section 6.7.4 of the National Data Guardian 2023-2024 report, and would not have provided sufficient benefit, additional to the existing function of Subject Access Requests. There was, therefore, no exploratory work completed on this subject. There are multiple ways for a patient's record to be accessed. Any patient-facing feature needs to take all these different routes into account and, as noted by the National Data Guardian, NHS England is considering whether this functionality might be possible in the Government’s plans for a single care record.

From May 2026, the first single collective action calls upon a practice to cease signing up to any new voluntary data sharing agreements (DSAs) that extract patient data for secondary uses , i.e. medical research conducted by charities, commercial organisations and universities or health service planning carried out by government agencies or local NHS organisations. Data used in this way is deemed non-essential for the direct patient care and therefore carries no inherent and immediate risk to patient safety if it is not shared. We are also requesting that each practice sends a template letter to its local system to assess each existing DSA the practice is currently signed up to.
