Right. Like, CIPA (without SB690) isn't addressing that issue. SB690 fixes the rent seeking issue. Ideal world, the government exemptions are federal privacy law territory, and I'm all for that!

I mean, at risk of losing my privacy user advocate cred here...I think SB690 is a good thing on many levels. A bunch of law firms who used to do ADA litigation, and then did mesothelioma litigation, all pivoted to doing CIPA litigation in the last few years, because that's where the quick buck is.

/Yeah/. CIPA was never intended to be used the way it's being used right now, such that any common third-party website cookie is equated to a pen register.

I don't love targeted advertising either, but CIPA lawsuits are a mess, and the legislature is trying to fix it. SB690 isn't perfect, but...
