The Alberta Court of Appeal has ruled that the federal government's Impact Assessment Act remains unconstitutional, marking the second time the province has challenged the legislation. In a 4-1 decision issued on Friday, the court determined that even after Ottawa amended the law following the Supreme Court's 2023 ruling that struck down much of the original act, the revised version still infringes on provincial jurisdiction. The court highlighted that the act grants the federal government excessive authority to halt projects within provincial boundaries if they have even minor impacts on federal jurisdiction. The ruling states that the legislation creates significant uncertainty by allowing for the application of previously undefined standards to designated projects, potentially enabling federal overreach into areas exclusively under provincial control. The court emphasized that while some modifications to the law were constitutionally acceptable, the overall framework still permits Ottawa to impose conditions, follow-up programs, or indefinite project prohibitions within provincial jurisdictions. Alberta had previously challenged the act, with Ontario and Saskatchewan supporting the province's legal position. The Impact Assessment Act, also known as C-69, has faced strong opposition from the oil and gas industry and critics like federal Conservative Leader Pierre Poilievre, who has referred to it as the 'no more pipelines act.' The ruling comes as Ottawa and Alberta are collaborating on a new West Coast oil pipeline project, with the Pacific Link pipeline recently receiving a national interest designation under the Building Canada Act. The federal government has introduced Bill C-39 to transfer pipeline and energy project assessments from the Impact Assessment Agency to the Canada Energy Regulator, claiming the latter possesses greater expertise in energy matters. However, the court's decision underscores that the Canada Energy Regulator will still operate under provisions of the now-ruled-unconstitutional Impact Assessment Act when conducting reviews. This development adds complexity to ongoing debates about federal-provincial jurisdiction over resource projects and environmental assessments.

Steven Shores presented ECMC's annual cumulative impacts report methodology and an estimate-to-actual comparison for recycled-water use.
