That said, this was a very poorly pleaded case and is vulnerable to appeal. But a better pleaded case cannot fail on the grounds of discrimination by national origin, mobility rights, or both.

Particularly the latter. I think he got lucky when U.S. overreach gave him an out from a bad trade deal he was moving toward signing. But the foreign investment summit followed by the EU visit has (at least) been a hell of a communications victory, in terms of conveying that Trump can't isolate us.
